Soft Play Rentals

This is a legal document between the client ”the renter” and Discovering Dreams Inc. which affects your legal rights, so please read carefully.

The renter desires to rent from Discovering Dreams Inc., equipment to be used by the renter, his/her guests, including minors, affiliates, and other individuals while in renters possession. Renter understands that the use of the soft play and/or bounce house equipment may, by it’s nature, cause injury or harm to client, his/her guests, including minors, affiliates, and other individuals.

I hereby freely, voluntarily, and without duress execute this release under the following terms:

1. Waiver and Release: I hereby understand and acknowledge that this release discharges Discovering Dreams Inc., from any liability or claim that the renter may have against Discovering Dreams Inc. with respect to any bodily injury, personal injury, illness, death or property damage that may result from the renters use and profession of Discovering Dreams inc. equipment. Renter does hereby release and forever discharges and hold harmless Discovering Dreams Inc., and it’s successors from any and all liability claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from renters possession and use of Discovering Dreams Inc. equipment.

2. Indemnification: I hereby agree to release, waive, and forever discharge and hold harmless Discovering Dreams Inc., and its members, agents, volunteers, insurer, or other representatives from any and all liability, claims, demands, attorney fees, costs, expenses and compensation arising out of or in any way related to any injury or other damage that may result to self (renter) or guests, including minors, affiliates, and other persons or whom I am otherwise responsible for while participating in or present at event, WHETHER ARISING FROM THE NEGLIGENCE OR RELEASES OF OTHERWISE.

3. Insurance: I hereby understand and acknowledge that insurance for liability, health, and medical or disability coverage in anyway related to the rental equipment under this agreement is the sole responsibility of the renter. I understand that I, my guests including minors affiliates, and all other persons are strongly encouraged to have a medical, physical exam and purchase health insurance before use of equipment.

4. Assumption of Risk: I hereby understand and acknowledge that participation in the activities which I am or/and guests, including minors, affiliates, and other individuals about to voluntarily engage in as a participant involves risk and may result in various types of injury including, but not limited to, sickness, bodily injury, death, emotional injury, personal injury, property damage and financial damage. I voluntarily assume all such risks using rental equipment , including risk known and unknown, of injuries, however caused, even if caused in whole or part by the action, inaction, or negligence of Discovering Dreams Inc. or it’s members, agents, affiliates, volunteers , or other persons (collectively , “releases”) to the fullest extent of the law.

5. Warranties & Representations: I hereby understand and acknowledge Discovering Dreams Inc. makes no representations or warranties as to the condition or operation of the rental equipment, which I am or/and guests , including minors, affiliates, and other individuals about to voluntarily engage in as a participant. The rental equipment is provided, and I (renter) accept the rental equipment on an “As Is’ basis and with all faults and defects. Lessor hereby disclaims any and all warranties, express or implied, with respect to the rental equipment, including but not limited to warranties or merchantability or fitness for the particular purpose.

Safety Rules and Procedures

PLAY AT YOUR OWN RISK

All children must be supervised by an adult (18 years +) at all times while in the play area.

Soft Play is suitable for ages up to 4 years old and MUST NOT be used by older children , adults, or infants not able to sit on their own

Absolutely NO PETS allowed in or around the play area

SOCKS must be worn at all times

NO shoes, sneakers, high heels, flip flops or sandals allowed inside or on the equipment, including mats

NO food, drinks, chewing gum, candy, of any kind etc.

NO FACE PAINT, temporary tattoos, party poppers, water bubbles, confetti (including balloons with confetti), colored streamers, slime, paint, markers, silly string, glitter, or any sticky items to be used either on or near play area ( products will cause permanent damage to equipment)

All sharp objects must be removed before entering play area ( including glass, pens, pencils, jewelry, keys, knives, eyeglasses, etc.)

NO flips or any kind, pushing, shoving, wrestling, or horseplay allowed

NO equipment or accessories, including balls shall be dismantled or moved outside of play area

NO climbing, pulling, slamming or sitting on the safety fences

NO BBQs, firepits, or heat emitted items permitted within 50ft of equipment

NO smoking in or around equipment

NO more than the recommended number of people and maximum weight allowed in the play area and/or bounce house at one time. Maximum capacity or participants is listed in the product description. ( Renter is to ensure that the area is not overcrowded, and the number of participants is limited according to age and size.)

Do not allow anyone to be in the inflatable equipment during inflation to deflation as this is dangerous.

In the event of a blower stopping, please ensure all users get off the inflatable immediately and calmly. Check the fuses and make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. In the event that it overheats, or loses power, switch the blower off at the mains, then switch it back 1 or 2 mins later and it should restart. If it does not inform us immediately.

NO Water play on the equipment. If swimming before please dry your children off before entering the play area/bouncer

Please do not enter play area if you are pregnant or have a physical injury or disability

If bad weather suddenly occurs, have all participants safely exit play area

Report all incidents or damages immediately to Discovering Dreams Inc.

I hereby understand and acknowledge:

1. I acknowledge responsibility to adhere to the rules and safety procedures mentioned above by Discovering Dreams Inc. in order to protect the equipment and provide a safe environment for me, my guests and any other persons who will have access to Discovering Dreams Soft Play equipment while in my possession.

2. I acknowledge sole responsibility of informing my guests and any other persons in attendance of the Discovering Dreams rules and policies in this contact agreement

3. I agree to not loan or sublet Discovering Dreams Soft Play equipment

4. I agree to pay in full replacement or repair cost, including labor and opportunity costs, if the soft play equipment is lost , stolen, torn, stained, or damaged beyond repair. Failure to pay by due date may result in a third party collections agency.

5. I acknowledge responsibility to ensure that all possible safety precautions are taken to avoid any kind of injury to the participants and/ or damage to equipment

6. I understand soft play equipment is for ages 4 and under

7. I understand it is prohibited to move equipment out of the original set up location ( moving equipment may cause injury and damage to equipment)

8. I understand no face paint, temporary tattoos, markers, pens, slime, silly string, food, drinks, pets, sharp objects, shoes, heels, etc.are allowed in or around play areas and rental equipment.

9. I understand that a down payment is due at time of booking and the remaining balance is due three (3) days before your event. Booking is not confirmed until initial payment is received.

10. I understand Discovering Dreams has the sole right to cancel event if remaining balance is not paid by the due date. Full deposit will be forfeited due to non-payment.

11. If equipment is returned excessively dirty, stained, torn, wet and/or moved from original set up location, including ball pit balls, a $100 cleaning fee will be charged. Excessive damage will incur replacement charges.

WEATHER POLICY:

If rain is forecasted at 50% or more during booked time we will not set up and a rain check will be given. ( Must set alternate date and time within 30 days of original booking.)

I further acknowledge the risks involved in Discovering Dreams Soft Play areas and assume all liability, including but not limited to any CHOKING HAZARDS, FALLING, TRIPPING, ETC., while in use. I understand that my guests and I are participating voluntarily, and that all risks have been made clear to me. I further acknowledge that I do not have any conditions that will increase my likelihood of experiencing injuries while participating in this activity.

I confirm and understand soft play equipment and mini bounce houses are only to be used for children 4 and under.

I confirm and understand no face paint, temporary tattoos, glitter, markers, crayons, slime, confetti, or silly string has been booked for the event. Please be aware products permanently damage equipment, and any indication will result in damage fees.

I confirm and understand not to move equipment in or outside play area and agree not to allow guests including children to move equipment. Moving equipment may lead to injury or damage to equipment. Damage fees will apply.
